Hi all, I’ve recently been asked if we could extend the general 6 month discontinuance of use resulting in the termination of an approved discretionary use (Home Based Business for example) up to 12 months. This 6 month discontinuance of an approved discretionary use resulting in permit termination seems to be very common in Land Use Bylaws or as a condition in the permits. The 6 month discontinuance for a non-conforming use also seems to be the standard. My question is, is there any legal precedence, or regulation, that has set this 6 month timeframe that may inhibit, or make it not advisable, to extend this to discontinuance of use up to 12 months?
