I am looking for feedback from other Rural Municipalities regarding the JUPA agreements we are working on with the School Boards. Does anyone have concerns or made any changes to the template with the Section on Servicing and Development of School Sites? More specifically c) which states “that the Municipality SHALL provide the services”.

SERVICING AND DEVELOPMENT OF SCHOOL SITES
a) All School sites shall be serviced to the property line prior to transfer to a Board.
b) The services to be provided include, but are not limited to: water, wastewater, storm drainage, power, natural gas, telecommunications, roads and sidewalks.
c) Where one or more services are not available at the property line of the School site, the Municipality shall provide the services subject to the legal and financial ability of the Municipality to do so.
d) Offsite levies or any similar charges for municipal infrastructure shall not be charged against development on any School site. This restriction does not apply to capital costs that may be included in a utility rate structure for use of the utility.

Our concern is that this may put the municipality in a position to have to extend services (water and wastewater) long distances to a specific site that School Boards want as we have a large municipal boundary. This could be a huge financial burden on the municipality. As well it lists the services of power, natural gas, and telecommunications which the municipality is not in control of.

Has anyone made any amendments/changes to this section and had buy-in from the Boards?
